Re: Makkar et v. Wilf et al, Docket No. UNN-L-00107-06, Additional Documents in Support of Motion Permanent Restraints For Developing Lot 26 & 27 Block 1105 in Springfield Township

Honorable Judge Anzaldi:

Please accept this letter-brief in lieu of more formal brief in support of plaintiffs Motion for Permanent Restraints and Criminal Prosecution of the defendants and other individuals and Companies involved in this sordid saga of corruption, bribery, favors and misuse of public office and public trust. Plaintiff is enclosing statements from Exhibit B to L of experts in various fields, residents of Springfield and some Board Members voicing opposition to these kinds of developments on this particular parcel of land during the Public Hearings conducted by the Springfield Planning Board during 2000 and 2005. It may assist the Honorable Court in its decision making process. These statements have been taken from the Transcripts of these hearings provided to the plaintiff by the Springfield Township Clerk and are true and accurate copies from the same.

The most disturbing question is how this particular parcel was included in the M-R Zone when no other parcel in the twp. of Springfield under M-R Zone resembles the land description of this Parcel at Wilson Rd. The Springfield Town Planner Michael Tobia in early ninety’s tempered with the definition of Critical Areas and Steep Slopes can safely be called the midwife to this scandal. In 2000 he unsuccessfully on behalf of Pinnacle Communities as their Planner tried to get approvals for 96 garden apartments in 4 buildings from the Board. Even the tempered definition of Steep Slopes and his arguments that the disturbance limits in the ordinance for steep slopes are arbitrary could not convince the Board barring Harelik & Grossbarth, Planner Michaels, Engineer Kirkpatrick, Fire Department’s David Maas, Residents of Springfield, Golf Club’s Expert and above all Counsel Bruce Pitman along with his experts, “that any development of this nature can be done on these Steep Slopes.” Counsel Bruce Pitman’s entire opposition, briefs and expert testimony against any development on this parcel was based on Steep Slopes and Critical Area for this land. He said, The Critical Slope Issue is the most Major Issue on this Project any massive invasion into Critical Slope area will be clear violation of Critical Slope Area Ordinance.”
In 2000 according to Planner Michael Tobia this parcel constitute 59% Steep Slopes in the entire land. Further he graded them 17% steep slopes of 15-25% grade and 42% steep slopes of 25% and higher grades. On March 27, 2005 Joseph Burgis Certified Planner for Counsel Bruce Pitman, Baltusrol Estates, Garden Homes, K & K Developers, Inc. and developer Zygmunt Wilf submits a Planning Report to the Springfield Planning Board in support of “C’ variance Application to construct 93 Luxury Condominiums in 3 storey single Building with 2 levels of Underground Parking. Further it states the site is steep terrains with 38% total land with steep slopes. A slope analysis indicate there are 13% slopes of 15-20% grade, 14% slopes of 20-25% grade and only 11% slopes of 25% and higher grades. This is in total contradiction to the data provided by Michael Tobia and accepted by Board in 2000. Objector Warren Bendixen, a Certified Planner for Balturol Golf Club forced Burgis to revise his assessment for steep slopes. Burgis revised these figures to 38% land with 25% or higher grade slopes and 13% land with 20-24.99% grade slopes. Council Bruce Pitman, some Board Members, Town Planner Michaels, and Engineer Kirkpatrick were aware these figures are much higher then what Burgis is showing. The reality is Lot 26 is 70%-75% with Steep Slopes and lot 27 is 60-65% with Steep Slopes.

Town Engineer Kirkpatrick writing to the Board that disturbance limits for Steep Slopes in the township ordinance is arbitrary using the same language as of Michael Tobia planner for Pinnacle in 2000 is scandalous. David Maas fire official not raising the issue of hardship rather hazardous conditions for a fire truck to go up is scandalous. Police Chief accepting an unqualified report from Cpl Dave Hartong rather then getting a Report from an Engineer based on Sight Distances and Traffic Count is scandalous. Board accepting a objector Counsel Bruce Pitman, wrong data for Steep Slopes, no Environmental Report from DEP, no Report from a Certified Forester, no report how many trees will be cut down & how many will be left, no Report from a Environmental Engineer, no discussion on the Geotechnical Evaluation Report, no Report for Combine Peak Runoff and its Effect, no report if all Grids gets Clogged for Water Management & Drainage, no Report on Global Stability in case of a massive failure to the Entire Hill and then granting massive variances which no other M-R development has in the town is THE BIGGEST SCANDAL IN THE HISTORY OF SPRINGFIELD TOWNSHIP.

In considering the papers submitted in support and against the Motion, I am hopeful Your Honor will adhere strictly to the legal standards in the best interest of the residents of Springfield and the State of New Jersey. Your Honor will analyze only the relevant facts, and render an objective, fair, and well-reasoned decision.

Zygmunt Wilf Democrat financier, attorney, real estate developer, owner of Minnesota Viking Foot Ball Team can rent out a Residential Road with a dead end for couple of $100,000.00 by converting it into a State Highway for oversized Trucks without any legal permission from the town or the consent of residents of the road.

This Ziggi Wilf can make town houses in the Parking lot of a 60 year old badly kept Apartment complex by getting all kinds of variances from a Planning Board crammed with Gluck’s community friends on the advice of a fellow community man a permanent fixture in Planning Board Mr. Bruce Pitman posing as Attorney.

Again Ziggi Wilf can blow up a Hill right next to a Christian Church (since it is not their Temple or Synagogue) under permission from Planning Board with all kind of unheard multiple illegal Variances on the advise of Counsel Bruce Pitman full of trickeries, hocus pocus, fiction, criminal acts, bribery, half truths & complete lies. Same Bruce Pitman few years ago for the same Hill Top untouched by human beings for over 100 years; while representing the Residents told the practically same Planning Board that any development on this Hill will be in violation to their “Land Use Ordinance, Master Plan & Steep Slopes Ordinance.” Also told the Board if they allow it then they don’t need all those ordinances and they must get rid of them.

Richard Collendrea as perpetual Chairman for last 2 decades of Planning Board along with members like Sy Mullman, Richard Huber, Sanford Wellen, Marjorie Grossbarth, Clara Harelick, Keneth Faigenbaum etc can allow any type of construction especially on the advise of Counsel Bruce Pitman including on going massive permanent Environmental damage to a Hill right next to Christian Church (because it is not their Temple or Synagouge) and facing National Monument Baltursal Golf Club so that poor Zygmunt Wilf can make his dream Luxury condos in gross violation of Land Use Ord, Steep Slope Ord & Master Plan of the Town which no other state in America or any country around the world will ever allow.

Mayor Sy Mullman after loosing election can be rewarded a Seat on Planning Board for signing the massive permanent Environmental damage so the popper Ziggi Wilf can make some money & distribute some to the Home Rule Members.

Kenneth Faigenbaum as Mayor can behave like a shouting gangster, misquote partial statements of his critics demanding accountability & questioning his signing off the Environmental destruction. Rather than answering why he sold himself to Wilf & Bruce Pitman can shamelessly wear the sufferings of warriors from his community from the holocaust era to hide his cowardly illegal, corrupt and racist deeds.

A habitual speed violator Steven Sobel hits an American Hindu mother & her 41/2 yr old son who just had a open heart surgery smashing the entire rear of their stationery car in broad day light on a quiet residential road and cops from his community writes a Report that the shell shocked woman & her son with almost $20,000 damage to her car has hit poor Sobel with $400-500 damage! Nice cop Mr. Quirk forgot that a high speed moving object in this case Racing Driver Sobel’s car is like a bullet/projectile to a stationery object and this bullet will rip apart every thing which comes in its way & nothing will happen to it.

A Judge Steven Firsichbaum can allows his court on the advise of his attorney friend Keith Biebelberg; to be used as a Ethnic Party room for eating & drinking as well as to prosecute threaten, intimidate, abuse & insult the victim on false charges of hitting the defendant on the testimony of false witnesses Barry Farbstein, Leslie Kasten, Lisa Glennon & Dobbs Auto Body, false & non existent imaginary evidences and a wrong interpreter imposed against the will of victim.

Keith Beibelberg friend of the Judge Firsichbaum can call the victim & her spouse “Sophisticated Con Artists” for complaining against the Racist & Corrupt Home Rule Members for prosecuting her on false charges to her Congressman.”

A woman cop Kahora can stops 5 & 9 yrs old Hindu children at Gun point from meeting their mother during court recess when Judge Firsichbaums court is being used as a Party room in his presence and the time is almost mid night. Home Rule members of her community can reward her with a promotion for this act of bravery!

Judge Firsichbaum can knowingly conspire to save a habitual speed violator being represented by his friend Counsel Biebelgerg by accepting false witnesses off course from the community who were not present at the venue of the incident, imaginary, false, fabricated & non existent evidences and forcing a wrong interpreter of his & Biebelberg’s choice on the victim an American Hindu woman.

A Mayor Clara Haelick can also make terrorist threats to a resident, “You have annoyed too many people (Home Rule Gang of my community) in the town, and you may not like the end results. (End Results: threats, coercion, intimidation, harassment, racial insults, parking summons under selective enforcement of law by a Dauser, vandalization of property & finally interrogation by State Police for being a Terrorist!

Mayor Clara Harelick, Councilmen Steven Goldberg, Kenneth Faigenbaum, Sy Mulman & Harold Poltrock , Police Chief Chisholm, Judge Firsichbaum can all gang up to silence the victim and her spouse for filing a complaint against Steven Sobel.

Gluck’s Ruler friends can also create a not needed position & hire fellow community member like Edward Fanning in their fag end of life with no qualification to match that job with a guarantee that they can not be fired for Political Reasons for 3 years from the date of their Appointment. All the Racist, corrupt sycophant in the Council can applaud equally corrupt & racist Clara Harelick when she compare Edward Fanning with hardly any/no qualifications or achievements in ¾ of his life without any shame with legendary Journalist Peter Jennings.

OPRA Rules are not applicable to community members of Gabriel Gluck.

If any one raises questions of accountability in Springfield, Gluck’s Ruler friends can arrange fire works at odd hours inside the property & near the parked cars of that person, vandalize property, break Car Screens, threatening letters, e-mails, phone calls, Parking Summons issued under Selective Enforcement of Law and when nothing works can get the State Police to interrogate this Justice demander on charges of Terrorism. Then refuse to provide the copy of the complaint filed with state Police.

WHEN MR. GLUCK WAS ASKED ABOUT MORALITY & ETHICS CONCERNING ALL THE ABOVE; HE SAID, “MR. MAKKAR YOU ARE AN IDIOT, YOU DON’T KNOW HOW THE TOWNS ARE GOVERNED.”


Certainly I am an idiot who have only seen in the past from a very close distance how the Government works under secrecy, corruption, misuse of religion & racism in India but never had the opportunity to see or experience the Journalist/Media Approved, Attorneys & Judges Supported “LEGALIZED CORRUPTION, LEGALIZED RACIAL SEGREGATION & LEGAL NAME “HOLIDAY CELEBRATION” for the biggest Religious Festival “CHRISTMAS” in the World.”

That’s what we have in New Jersey under the Rulers supported by Mr. Gluck.

I told you in 2005 also I am willing to have a Public Debate with you and all the Rulers of NJ on how New Jersey is being run by Scoundrels posing as Attorneys & Politicians in the name of Home Rule which is nothing but Legalized Gang Rule.
