HIS COMMENTS ON THE TOWN ORDINANCE FOR CRITICAL SLOPES

He prepared a fraudulent letter on Oct. 19, 2005 for the Planning Board to support the Development Application of K & K and Wilf to disturb the Steep Slopes of 25% grade and higher by 35.3% which is 7 times the town ordinance limit of maximum 5% for such Slopes . Mr. Kirkpatrick has no formal education or experience in the field of Environmental Engineering neither he is State Certified Forester. In that he claimed that “The protection level indicated in the ordinance are arbitrarily based on arbitrary numbers which are not supported by any scientific evidence or principles and they are not consistent with laws of physics. The same argument was given by Planner Michael Tobia for the development application of Pinnacle for the same property in 2000 which was rejected by the Board for the main reasons of Steep Slopes. Mr. Bruce Pitman’s entire opposition or brief or pleading as objector to Pinnacle was based on Steep Slopes that due to STEEP SLOPES nothing should be built there.
ENVIRONMENTAL ENGINEER BRYAN VANDERGHEYNST: “Although the actual 40%, 20% and 5% restriction levels may be somewhat arbitrary, I don’t think any body can dispute that because of the laws of physics and the laws of gravity that steeper slopes are more susceptible to erosion and failure. And of course I believe that the ordinance, the intent and the numbers accurately reflect this line of thinking.”
TOWN ORDINANCE: 35-15.5e(1) The location of the principal or accessory structure in critical areas shall be MINIMIZED to the greatest practical, and shall be pursuant to all State and federal regulations. Additionally disturbance of steep slopes shall not exceed the following: Catagory 15-19.99% maximum disturbance 40% (2) Catogory 20-24.99% maximum disturbance 20% (3) Catagory 25% and over Maximum Disturbance allowed is 5% only. We had expressed some concerns about Storm Water Management and Drainage on the site. Mr. Huber had the same concerns for both developers and both times he got evasive responses.

HIS MAIN CONCERN: “IF THE ORIFICE WERE TO CLOG AND THE PRINCIPAL SPILLWAY WERE TO CLOG?
Lanzfama for K & K: THE EMERGENCY SPILLWAY WOULD KICK IN.”
HUBER: IF THAT CLOGGED AS WELL? (If all the grids clogged)
Lanzfama: Then there is adequate volume within the detention facility to hold an important amount of water. I HAVE NOT DONE THE ANALYSIS WITH ALL THREE CLOGGED.

Surprisingly Town Engineer ROBERT KIRCKPATRICK agreed with their plan and wrote a letter to Planning Board on Oct. 19, 2005 giving them an O.K.

ENVIRONMENTAL ENGINEER VANDERGHEYNST DO NOT AGREE:
“RSIS permits a slope of 3 to 1 in and around Detention Basin we agree with the comment of Mr. Kirkpatrick. But the slopes just below the proposed Basin Berm in some areas exceed 2 to 1 or actually 11/2 to 1. “WHICH IS TWICE THE PERMISSIBLE SLOPE AGAIN THIS COMES BACK TO THE STABILITY AND THE SAFETY OF THE IMPILEMENT?”

20-24.99% 20%
20-25% and over 05%

AWARD TO MORALLY, ETHICALLY & PROFESSIONALLY CORRUPT

Dear Sir/Madam:

Please be advised it will be the biggest blunder and a matter of shame for NJSPE to award “Distinguished Engineering Service Award” to a morally, ethically and professionally corrupt engineer Robert Kirkpatrick on June 8, 2006.

This individual is a disgrace to your organization and has no ethics, morality and professional honesty. He can make 2 statements for the same parcel of land under greed and Pay-To-Play awards. Can go to the extent that “Protection Levels indicated for Steep Slopes in the Springfield Twp. Land Use Ordinance are arbitrary based on arbitrary numbers which are not supported by any scientific evidence or principles and are not consistent with laws of Physics” to get approvals for a criminal developer.

The same Land Use Ordinance defining protection levels for steep slopes for the same parcel of land Robert Kirkpatrick used against a “Builder of not his choice” or may be he was not taken into confidence by corrupt & racist Mayor & Planning Board Member Clara Harelik that he will be part of the game called Pay-To-Play, few years ago to reject Pinnacle Communities (Builder) proposal for residential development.

That is besides the point both builder’s have proposed horrendous anti environment, anti wildlife, anti residents plans to blow up a 297 feet high Hill Top to make luxury Garden Apartments or Condominiums by flushing down in the toilet the town’s Master Plan & Land Use Ordinance. In the end, in Pay-To-Play game the winner has to be one who has more political clout, more rich and from the majority community of the town; who else than Zygmunt Wilf a criminal developer, financier to Democrats, an attorney, the uncrowned King of Springfield and Union County can fit the description.

Mr. Kirkpatrick dishonestly along with corrupt & racist planning board and administration of Springfield is responsible for ruining the sky line of Springfield. According to these brain damaged, blind, greedy, racist and corrupt individuals, “Construction is by Variances only not by the Land Use Ordinance, Master Plan or Colonial seal and character of the township of Springfield. The glaring examples are:

1. Ron’s Edge a single family home development by none other than King Zygmunt Wilf. Ugly & disproportionate looking massive structures on very small lots.

2. Town Homes & Luxury Apartments built in 2005-06 on the parking lots of a 45 year old Mountain view Gardens badly kept apartment complex by King Wilf. All kinds of absurd, non-sense variances including more height then existing Slum without application of mind and disregard to the public safety were awarded in this project which even the most corrupt Municipality of America will not award.

3. Benjamin Rd. # 7 with practically no back yard and 42% more coverage on a small lot looks like a mini Walmart on that street of small houses on similar lots.

4. In 2005 with the unlawful, illegal active cooperation of the Springfield Planning Board and entire administration King Wilf rented for more then 4 months a residential road “Ashwood Rd. with a dead end on one side for Undisclosed Amount of Money by illegally and unlawfully converting it into a State Highway for Extra Heavy Commercial Vehicles without the consent of the residents.

5. 165 Mountain Ave. a Dentist Practice (2006) an Eye Sore between 2 Colonial Structures not confirming to the existing development another proof of blind, brain damaged, corrupt & racist individuals governing the twp. of Springfield.

6. In 2006 those governing Springfield has crossed all the limits of humanity by sacrificing their love for the town & its residents, love for the environment, love for the wildlife, love for our country and its prestige; gave a mandate to King Zygmunt Wilf to construct a “Monument of Corruption” by chopping off 60 feet from a 297 feet high Hill Top right across to the National Monument Baltusrol Golf Club. 93 Luxury Condos in 3 storeys with 2 storey underground parking in one massive structure will be built by blasting all the trees, vegetation and wildlife. It will be supported by 4500 linear feet of 18 feet high Brick & Mortar Retaining Wall wrapped around the Hill Top. The so called land under this Monument of Corruption is more then 65% Steep Terrains (Slopes) of 25% and higher grade slopes. Robert Kirkpatrick is the inspiration for this monument. Any development on this particular lot by Kirkpatrick, Police Dept., Fire Dept., town Planner, Board members barring Mayor Harelik and Ms. Grossbarth were opposed in 2000 besides the residents represented by Counsel Bruce Pitman. The same Bruce Pitman a big fraud represented King Wilf in 2005-6 to get approvals.

Further please be advised Division of Criminal Justice at state Attorney General’s office and state DEP Environmental Crimes are looking into this Grand Criminal Conspiracy involving the Hill Top on Wilson Rd. in the twp. of Springfield. The undersigned’s appeal to probe the intentional unlawful criminal wrongdoings by individuals involved in the conspiracy is pending with the Appellate Division of Superior Court of NJ. The undersigned makes a humble appeal for the support of NJSPE to save the Springfield Hill Top and immediate expulsion of Robert Kirkpatrick from NJSPE.
