FINDINGS OF THE BOARD ON LOT 26&27 IN 2000

SPRINGFIELD PLANNING BOARD FINDINGS NOV.01, 2000

42% OF THE ACREAGE CONSTITUTE 25% AND ABOVE GRADE SLOPES.
17% OF THE ACREAGE CONSTITUTES 15-25% GRADE STEEP SLOPES.
59% OF THE TOTAL ACREAGE CONSTITUTES STEEP SLOPES.
CONSTRUCTION OF PROPOSED BUILDING WILL REQUIRE BLASTING FROM AN ELEVATION OF 290 (ACTUAL 297) FEET DOWN TO 262 FEET.
PROPOSED BUILDING WILL REQUIRE RETAINING WALLS TO BE ERRECTED OF VARYING HEIGHTS AND WITH A TOTAL HEIGHT IN SOME LOCATIONS EXCEEDING 34 FEET.
APPLICANT NEEDS VARIANCE FOR EXCEEDING THE PERMITTED BUILDING HEIGHT IN THE ZONE OF 35 FEET TO 38.5 FEET (FOR ZYGMUNT WILF IT IS 45.5 FEET).
VARIANCE FOR LIVING QUARTERS ON THE THIRD FLLOR: “Living Quarters are not permitted on the 3rd storey. The applicant’s justification for 3rd Storey and Living Quarters therein was the Greater Yield from the project and Board DOES NOT FIND THIS TO BE JUSTIFICATION FOR THE VARIANCE.”
VARIANCE FOR 3 STOREYS WHERE 21/2 IS PERMITTED:
“21/2 storey is the maximum permitted in the Multi-Family Residential Zone and is not exceeded throughout the Township. THE APPLICANT FAILED TO SATISFY THE NEGATIVE CRITERIA FOR THE VARIANCE.”
PROPOSED BUILDING HEIGHT 38.5 FEET (ZYGMUNT WILF 45.5 FEET) ON TOP OF RETAINING WALLS OF UP TO 34 FEET DOES NOT MINIMIZE THE
IMPACT ON ADJOINING PROPERTY OWNERS, AND CREATES STRUCTURES WHICH APPEARS TO BE 70 FEET HIGH AND HIGHER IN THE ZONE WHERE MAXIMUM PERMITTED HEIGHT IS 35 FEET. DEVELOPMENT OF THE SITE WITH STRUCTURES EXCEDING HEIGHT LIMITATIONS IS CONTRARY TO THE INTENT OF THE ZONING ORDINANCE AND CLEARLY NOT IN KEEPING WITH THE ZONE PLAN AND THE SURROUNDING PROPERTIES. TO PERMIT THIS DEVELOPMENT WOULD IMPAIR THE INTENT OF THE LAND USE ORDINANCE.
NO PERSUSIVE EVIDENCE OF HARDSHIPS OTHER THEN ECONOMIC WAS PRESENTED AS TO THE VARIANCE FOR LIVING QUARTERS ON THE 3RD STOREY.
THE PROPOSED DEVELOPMENT IS NOT A SITUATION WHEREIN THE PURPOSE OF LAND USE LAWS ARE ADVANCED BY DEVIATIONS FROM THE ZONING ORDINANCE REQUIREMENTS MAINTAINING THE INTEGRITY OF THE MR ZONE AND ITS REQUIREMENTS PARTICULARLY IN THIS CRITICAL SLOPE AREA IS OF GREATER BENEFIT TO THE SURROUNDING PROPERTY OWNERS THEN PERMITING CONSTRUCTION OF 3 STOREY BUILDINGS.
